General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers, as defined in § 13 BGB (German Civil Code), through the NEVO Store online shop.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the "Buy", "Pay now" or a similar button, you place a binding order for the goods contained in your shopping cart.

The contract is concluded when we accept your order by an order confirmation via e-mail or by shipping the goods.

4. Prices and Shipping Costs

All prices stated are final prices in Euros.

If differential taxation according to § 25a UStG (German VAT Act) is applied to individual goods, no separate indication of sales tax will be made.

Shipping costs may be incurred in addition to the goods price. The specific shipping costs will be displayed during the order process.

Shipping costs:

Germany: €4.50
Austria: €13.99

For orders with a value of €30 or more, we deliver free of shipping charges within Germany.

For deliveries to Austria, the shipping costs displayed during the order process apply. We currently do not offer free shipping to Austria.

5. Delivery

Delivery is made via DHL to the delivery address provided by the customer in Germany and Austria.

Processing time is usually 1–2 business days.

Delivery time is usually:

Germany: 1–3 business days
Austria: 2–5 business days

The stated delivery times apply from receipt of payment or from order confirmation, unless a different delivery time is specified in the respective offer.

Delivery time may vary depending on the destination, holidays, and capacity of the shipping service provider.

6. Payment Methods

The available payment methods will be displayed during the order process.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal in accordance with our cancellation policy.

8. Voluntary 30-Day Return Policy

In addition to the statutory right of withdrawal, we offer a voluntary free return within 30 days of receipt of the goods.

This voluntary return option is only valid if the item is returned complete, carefully packaged, and in the condition in which it was delivered.

For used items such as video games, consoles, and accessories, careful inspection is permitted. Use beyond normal inspection, damage, missing parts, or a significant deterioration in condition may lead to a reduction in value.

For new goods and sealed items, the goods must be returned unopened and originally sealed if they are to be refunded as new goods. If the seal is removed or the packaging opened, we will assess a possible reduction in value on a case-by-case basis.

Any bonus, DLC, download, online, or other codes included or shown in the images of used items may already have been redeemed or expired, unless explicitly stated otherwise.

The statutory right of withdrawal remains unaffected by the voluntary 30-day return policy.

9. Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal also does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

10. Retention of Title

The goods remain our property until full payment has been received.

11. Warranty / Liability for Defects

The statutory liability for defects applies.

For used goods, signs of age and wear may be present. The respective condition is stated in the product description. Deviations described in the offer or visible on the product photos do not constitute a defect.

12. Dispute Resolution

We are not obliged and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as no mandatory consumer protection regulations conflict with this.

Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the statutory provisions shall apply.
